Daniel Smith October Update
October 16th 2017
In September's Daniel Smith Update the 3-Judge Panel had not ruled on Daniel's appeal yet.
Now another month has elapsed and we ask: How did the Judges rule?
No one knows...yet.
What? Is this for real?
Absolutely. Daniel sits in a prison cell marking Xs on the wall while the only message from the 3-judge Panel is Paul Simon’s classic: The Sound of Silence. How do you think Daniel feels since the Oral Appeal hearing was held 7 weeks ago (48 days) and nothing has happened?
I don’t think I remembered to tell you last month that Daniel’s superb Defense Attorney began that appeal hearing asking that the 3-Judge Panel release Daniel on bail while they were deciding how they were going to rule on his appeal. How did the Judges respond? The Sound of Silence.
I’ve anxiously been waiting for almost 2 months now to hopefully write great news from this 9th Circuit Court of Appeals 3-Judge Panel.
Once their ruling is in I’ll update you ASAP.
Today, October 16, 2017, Daniel is in his 3rd year in prison. He has been jailed for 908 days after not being allowed to even put on a defense which is every American’s Constitutional right...isn’t it?
BACK AT SEA-TAC FEDERAL DETENTION PRISON
Daniel had a minor surgery this month that appears to be healing fine. He is loving the contact that many of you have been making: letters, greeting cards, books, magazines, even emails. Let me mention how it works if you’d like to try to send him an email.
It can be done - but not easily. He has two email accounts. One is available to all Federal Inmates and it requires considerable red tape to set up ~ getting through all of their approvals. It limits how many people with whom he can email. All emails are delayed about 2 hours which allows guards to prescreen.
Then Daniel found an email server for which we pay a small monthly fee. I’m unsure how the Bureau of Prisons deals with it since they provide the computer. It has occasional glitches and then at other times works fine. I’m sure the guards prescreen this as well.
With either email server ~ he can not use the Internet, receive attachments or pictures. It is strictly a way to communicate with simple electronic letters. If you’d like to give it a try here is that second email address:
Some supporters say it works OK, others have had problems. Sorry, but if it doesn’t work - I’m clueless to help you...as I’m not a techie at all.
Personal Message from Daniel:
"Dear Ones, Here it is a time of Hopefulness though I am a bit mystified why the Judges' decision isn't known yet. If it wasn't for all of your prayers and encouragement this could have been far worse. But thanks to you for your letters and cards from all over the world. I have been embraced and loved by each and every one of you. Thank you from all of my heart. May your days and weeks be most warm and special." ~ Daniel

Please Note: It is not possible for Daniel to have his own bank account while in prison ~ that’s why, I his father, receive it for him. To be deposited for Daniel’s and his family’s use it needs to be made out to Larry Smith.
